Terms of Service and User Rules | Website Builder

1. Introduction

Welcome to WeblyBase ("WeblyBase", "we", "us", or "our"). WeblyBase provides tools and services that enable individuals and businesses to create, customize, publish, and manage websites using ready-made themes, plugins, page-building tools, and related digital features.

These Terms of Service ("Terms") govern your access to and use of the WeblyBase website, applications, platform, subscriptions, themes, plugins, and related services (collectively, the "Services").

By accessing or using our Services, creating an account, or purchasing a subscription or digital product, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must have the legal capacity required to enter into a binding agreement under applicable law.

If you use WeblyBase on behalf of a business or another organization, you represent that you have authority to bind that organization to these Terms.

You agree to:

  • Provide accurate and current registration and billing information.
  • Maintain the confidentiality of your login credentials.
  • Notify us promptly of suspected unauthorized account access.
  • Accept responsibility for activities performed through your account, subject to applicable law.
  • Avoid sharing account access except as expressly permitted by your plan.

We may request information reasonably necessary to verify an account, prevent fraud, or comply with legal obligations.

3. Description of services

Depending on your selected plan and the features made available to you, WeblyBase may provide:

  • Website creation and publishing tools.
  • Ready-made themes and templates.
  • Plugins and extensions, including SEO, galleries, page builders, eCommerce, appointments, and payment-related functionality.
  • Website customization and management features.
  • Subscription management and account dashboards.
  • Third-party integrations and optional add-on services.

Features, usage limits, storage, integrations, support, and availability may vary by plan. A feature is not included in a subscription unless it is expressly identified as included in the applicable plan or order.

Unless specifically included in your plan, WeblyBase does not guarantee that domain registration, email hosting, third-party hosting, payment processing, or other external services are included.

4. Subscriptions, fees, and payments

Certain Services may require payment. Prices, billing intervals, applicable taxes, included features, and usage limits will be presented during checkout or in the applicable order.

By purchasing a paid subscription, you authorize the applicable payment provider to process the charges you approve. You are responsible for keeping your billing information current.

Unless your order expressly states otherwise:

  • Subscriptions renew according to the billing interval displayed at checkout.
  • Renewal charges may apply until you cancel.
  • Applicable taxes and transaction charges will be handled as required by law and the checkout terms.
  • Paid add-ons may have separate charges or license conditions.

We may change prices for future purchases or renewals by providing notice where required by applicable law or your agreement. A price change will not retroactively alter a completed purchase.

5. Cancellation and refunds

You may cancel your subscription through the available account controls or by contacting our support team.

Cancellation generally prevents future renewals; it does not automatically entitle you to a refund for an already-paid period.

Refund eligibility is governed by our Refund & Cancellation Policy, applicable checkout terms, and mandatory consumer protection law. Nothing in these Terms removes a right to a refund or remedy that cannot legally be excluded.

6. Themes, plugins, and licenses

Subject to payment, plan eligibility, and applicable license terms, WeblyBase grants you a limited, non-exclusive, non-transferable right to use the themes, plugins, templates, and other digital products made available to you.

Unless an applicable license expressly permits it, you may not:

  • Resell or redistribute paid products as standalone products.
  • Share paid downloads or license keys with unauthorized persons.
  • Remove ownership notices where prohibited.
  • Circumvent licensing, access controls, or usage restrictions.

Third-party software may be governed by separate open-source or third-party licenses. Those licenses apply to the extent they govern the relevant components.

A subscription does not transfer ownership of WeblyBase's intellectual property to you.

7. Your website and content

You retain ownership of content you lawfully create or upload, subject to third-party rights and the licenses necessary to operate the Services.

You are responsible for:

  • The legality, accuracy, and permissions associated with your website content.
  • Obtaining consent where required to collect personal data from your visitors.
  • Publishing appropriate privacy, cookie, refund, and other notices for your own website.
  • Securing your website, accounts, and connected services.
  • Configuring payment, eCommerce, appointment, and other integrations correctly.
  • Ensuring your website complies with applicable laws.

You grant WeblyBase a limited license to host, store, process, reproduce, transmit, and display your content only as reasonably necessary to provide, maintain, secure, and support the Services, and as otherwise permitted by your instructions or applicable law.

We will not acquire ownership of your content merely because you use WeblyBase.

8. Acceptable use

You must not use the Services to engage in unlawful activities, distribute malware, conduct fraud, send unauthorized spam, infringe intellectual property, interfere with systems, or violate the rights of others.

You must not attempt to gain unauthorized access to accounts, servers, APIs, databases, or administrative systems, or circumvent security measures, subscription restrictions, or licensing controls.

Additional requirements appear in our Acceptable Use Policy.

9. Third-party services

The Services may integrate with external hosting providers, domain registrars, payment processors, analytics tools, email services, APIs, and other third-party products.

Third-party services are governed by their own terms and policies. WeblyBase is not responsible for services operated independently by third parties, except to the extent responsibility cannot lawfully be excluded.

An integration may be changed, limited, or discontinued if the third-party provider changes its service or access conditions.

10. Availability and changes

We aim to maintain a reliable service but do not promise uninterrupted or error-free operation unless an express service-level agreement states otherwise.

We may perform maintenance, deploy updates, modify features, address vulnerabilities, or discontinue features where reasonably necessary. Where required, we will provide appropriate notice.

We will not exclude remedies for material failures where applicable law requires them.

11. Suspension and termination

We may suspend or restrict access where reasonably necessary to investigate fraud, address security risks, prevent harm, respond to unlawful conduct, enforce these Terms, or comply with law.

Where appropriate and legally permitted, we will provide notice and an opportunity to resolve the issue.

You may stop using the Services or cancel a subscription according to the applicable cancellation process.

Following termination, access to certain features or hosted websites may cease. You are responsible for exporting your content before access ends, where export functionality is available. We will handle retained data according to our Privacy Policy, contractual commitments, and applicable law.

12. Intellectual property

WeblyBase and its licensors retain rights in the platform, software, branding, documentation, and materials that they own.

Except for the limited rights expressly granted in these Terms, no intellectual property rights are transferred to you.

You may not copy, reverse engineer, modify, distribute, or commercially exploit protected elements of the Services except as permitted by law, an applicable license, or our written permission.

13. Warranties and liability

The Services are provided subject to applicable law and any express warranties in your order or separate agreement.

To the extent permitted by law, WeblyBase excludes implied warranties that may lawfully be excluded. We do not guarantee that your website will achieve a particular level of traffic, search ranking, revenue, conversion, or business performance.

To the extent permitted by applicable law, WeblyBase will not be liable for indirect or consequential losses arising from use of the Services, including loss of anticipated profits, business opportunities, or data, where such exclusion is legally enforceable.

Any limitation on direct damages must be specified in the final version of these Terms in a manner permitted by applicable law. Nothing in these Terms excludes liability that cannot legally be excluded or restricted, including applicable statutory consumer remedies.

14. Indemnification

To the extent permitted by law, you agree to be responsible for third-party claims arising from your unlawful use of the Services, your infringement of third-party rights, or your material breach of these Terms.

This provision does not require you to indemnify WeblyBase for losses caused by WeblyBase's own unlawful conduct or for liability that cannot legally be transferred to you.

15. Governing law and disputes

These Terms are governed by the laws of [applicable jurisdiction], subject to mandatory consumer protection laws and any other non-excludable legal requirements.

Disputes will be handled by the competent courts or dispute-resolution mechanisms applicable under that law. Nothing in this clause removes any non-waivable rights you may have as a consumer.

16. Changes to these Terms

We may update these Terms to reflect changes to the Services, our business, or applicable law. Material changes will be communicated through appropriate means where required.

The updated version will state its effective date. Continued use after the effective date constitutes acceptance only to the extent permitted by applicable law.
